The Grey Area Of Cannabis Sativa
Hemp VS Marijuana
THC/CBD Legality in the United States

Can't we just Legalize the plant.... Seriously? This is just turning into a cluster and it honestly is opportunity for those who risk it all for the money in front of them. If the plant is the eradicate the illicit market and the associated negatives that follow an illicit substance market, then having a state totally ban Cannabis in both of its forms, Hemp and marijuana whilst states next door legalize to the fullest extent to recreational, this is merely creating an interstate market for the black market. That interstate market is also likely a higher revenue market given the interstate nature. This isn't even mentioning the trucks loaded up at bay doors which heads to dudes when the vans are loaded for the dispensaries. The black market is going nowhere with the current largely "social Equity influenced" market were seeing state by state.
Maryland hadls had issues with this precise circumstance. The Cannabis Marijuana industry, the industrial side was and is suing me Maryland Hemp Industry, claiming they need to abide by the legislation stipulayed for cannabis marijuana for recreational use. Hemp is a very good marketplace, but it doesn't pull the revenue which raw marijuana does, even with CBD concentrates and edibles. So asking the hemp industry to fork over $50,000 for liscencing in a state which they have been operating in, is absurd. This is all greed of industry. And directly related to the South Dakota Ban on CBD products.

The industry is pissed that the hemp market has discerned a means of utilizing the miniscule.leveos of THC present in hemp and combined with CBD using science the compounds can be turned into synthetic cannabinoids which mimic the effects fairly nicely and getting close and closer as time proceeds and research proceeds. For example, there is the concentration of THC in the 0.3% (or less) level which is isolated and combined with a CBD to THC method also a product of this research to create a semi synthetic cannabinoids. That seminary synthetic cannabinoid is Hexahydrocannabinol aka HHC. IT IS semi Synthetic as it does contain trace levels of actual THC. Where as THCP, THCO, DELTA 8, DELTA 10 and others can be isolated and combined in various manner to create synthetic cannabinoids.
These synthetic cannabinoids do not get one as stones as cannabis, not are they as relaxing or do they take the edge off that an experienced or even simply informed cannabis user would expect from Marijuana. . . Because it's Hemp. It is allowed to be sold only for non therapeutic reasons except.by the FDA in their distribution of Epidiolex, an anti seizure medication stolen from the Stanley Brothers discovery of CBD amplification alongside THC diminishment. CBD products can be sold, and they can be sold with statements like " lift your mood" or " do you wana get high" only because of the colloquially accepted social understanding of cannabis. First that statement is a simple question and isn't inferring that the product will actually get you high, it isn't stated. Lifting of a mood is subjective. Notice you won't see any objective terms of certainty used in these advertisements. Like the advertisement for Mood Cannabis. Yes cannabis, Hemp cannabis.

These terms I would venture to say arent legally binding as would say " gets rid of muscle tension through proliferative & topical analgesic soft abrasive application via bath bombs." But you can say "eases tension from a long day" this is more subjective. This is all coupled along with the accepted idea that cannabis is different for everybody. Nobody experiences it the same, and while this is true, that occurs within a range of experience. One person isn't going to be hallucinating while another is drooling and another jumping from a building. That doesn't happen. By variation one person may not even feel it, one may have an unpleasant myrcene induced psychoactive overload, one may be sedated. Some people get focused with sativa, some can't focus. This is the variation in difference of cannabis experience.

The FDA sends cease and desist letters to companies on the regular when they.catch wind of a company, even a start up using therapeutic inferences in their advertisements of Hemp based products. Now that isn't to say that these same products can't be sold.for non therapeutic recreational purposes. Maybe you enjoy the smoke, or just like the smell. This is fine, but the moment a claim of medicinal affect is applied, it becomes a federal issue. Even Charlotte's Web tincture, the product designed by the Stanley Brothers to to quell seizure activity in a client of theirs, a child.
This was accomplished and Epidiolex was placed on market 8 years later with the hemp act following the discovery in 2008 in 2014. In 2016 it was on market with a single trial of 120patients which conveniently enough took place at the same institute where researchers for decades were sent by the FDA to study cannabis and produced null results almost always. Amazing the FDA CONCLUDED something that took skilled botanists and geneticists years to develop was viable for use in children, considering that substance is a Schedule One Worst of the worst categorization. Funny that.
The research abilities of scientists and other interested parties has been blatantly hampered by the FDA AND INTENTIONALLY SO. they for decades have diverted science to sub oar grown cannabis intentionally cultivated by FDA assigned persons in order to ensure non success of therapeutic research in cannabis. The cannabis compared at no level to even swag, it was so low quality scientists often could not discern the difference between the control, the cannabis and the placebo. Yet the FDA CONCLUDED that this newly discovered application of CBD WAS A VIABLE MEDICINE. THAY QUICK . BECAUSE prior to the discovery it was Far too expensive to isolate and extract CBD in a cost efficient manner, with natural growth of high CBD plants, the FDA wasted no time re identifying hemp as including high CANNABIDIOL LEVELS ALLOWING THEm to claim that hemo production is correlated to CBD and thus controlled by the federal government.

The proof of this is seen very clearly in the fact that at every turn where profit is incurred, the state or federal government is there to push in big business and enslave the population of those areas to work minimum wage positions facing predatory hiring oracti es from multi million dollar interstate businesses. Businesses of rich white men, 75% rich white men in Maryland in THIS RACE BASED SOCIAL EQUITY MARKET where the first black owned entrepreneurial Maryland residents owned Small business, is forced to open shop under the title of Curio. So our state allowed out of state interstate multi million dollar business to inundate the state and build a loyal clientele, cornering the entire market.

Then tells disproportionately effected persons, aka people from High crime neighborhoods that they need only their years salary for a cannabis licence $50k. That's for a chance to attain a licence, which you pay $5,000 for getting. Without a million on hand, the disproportionately effected by cannabis prohibition they aren't getting involved in cannabis. You can work at minimum wage and survive under predatory hiring like non compete clauses for trimmers and budtenders. Or a 2 year non compete like I signed with Trulieve, fired a week later with 0 consideration for what they did to my career. And I was legit set up by my overlords to be fired, industry isn't what is was supposed to be. I hope all of it isn't as terrible as trulieve and the way they treated me there.

So that's an outline of the current situation. Yes you can get CBD products technically in every state if that state has no stipulation regarding hemp products, but most do, or they create it quickly. Most states are on board with the underhanded sales of CBD products for therapeutic purposes, essentially swelling for one thing but using for an "off label " reason which is really it's true application.

Louisiana is one of the states which has banned all Hemp products that can be smoked except for hemp Derived rolling papers. Act 344/ HB 843 is the exact bill if you want to reference that. Many states are being sued due to these illegality statutes placed in cannabis Hemp smokable products as it is impeding the legalization process. Though I'm not convinced this legalization process is seeking to benefit anybody but the state and those willing to play along and eithebbe a oeasent at minimum wage or play their absurd million dollar money man game.
I mentioned the lawsuit between the cannabis industry in Maryland and the Hemp industry. The issue precisely there is essentially what I spelled out, the cannabis companies are upset that they're loosing revenue on people purchasing delta 8, THCO, THCP, HHC, etc which do produce intoxicating levels of cannabis product similar to the oaychoacitvie experience of the medicinally and recreationally legalized cannabis marijuana plant. Marijuana referencing the high THC CANNABIS SATIVA (indica is a sub categorization of Sativa, sort of but not really.)

So Maryland wants to stop sales of all products which can cause altered states. This is supposed to be the place of the recreational side of the industrial DUAL market that monopolized the cannabis scene from Maryland OGs, legacy market operators and residents wanting a piece of the action.
However, the hemp industry fights back claiming that this is against the fair operations The Current Status of Cannabis In America & The state Vs Federal Government Issues. Hemo sales, specifically of these products which cause altered states of consciousness it is argued by the cannabis industry are a part of the new legislation which allows for the medicinal market to maintain control of the entire market overall by maintaining control of production and sales.of loose concentrates, and states that the sales.of CBD Derived THC products is against this legislation.

The hemp industry argues that they're merely utilizing science the use the legalized version of the Cannabis plant. It is after all the FDA who was insistent t on changing the definition of Hemp to include High CBD or this wouldn't be an issue. While.i understand that the CBD Derived products are indeed being utilized in many instances for recreational purposes, the fact remains that it was synthesized using the legalized form of the cannabis.
This to me is comparable to the FDA creation of Marino and Droninbinol in the 1980s, casamaet later, synthetic services from components of cannabis that mimic the psychoactive and analgesic sedating effects of cannabis. Literally it is exactly the same issue. The hemp industry is specifically arguing that these asks vehinently violate the Maryland Constitutions equal protection and Anti monopoly clauses. In my opinion it's far last time to concern ourselves with a monopoly as it's already here.
They are pointing to the FAVT that implementation of what the cannabis industry is asking would shut down their businesses which were operable ore cannabis legalization in Maryland and actively prevent them from competing on a highly regulated market. A market regulated by the individuals using the hemp industry. Industry set it up, now they want it all. I am rooting for hemp, as it is the last hope of legal small business in Maryland.
Following Louisiana suit North Carolina set out a few months ago to ban all smokable hemp Derived products. North Carolina law states that CBD products will still be available, but the smokable hemp products like CBD flower, moon rocks, distillate, and dabs aren't legal any longer. However, with this said in must also consider the fact CBD can't be sold.for therapeutic intent, ergo, they're saying recreational use of hemp Derived products is OK. Seems very silly. To drive a synthetic for of aan existing compound known to be non harmful in order to then allow a crude representation of that product using CBD isolation and THC extraction methods, and converting THE CBD TO THC.

This is another important benefit that the synergistic nature of cannabis has to offer, the terpenes and cannabinoids can easily be converted to one another very simply. However, this is the case in North Carolina. South Carolina is even worse is their views in cannabis legalization. In South Carolina legislators recently passed legislation denying even the terminally ill access to medicinal cannabis which is very old.schol.
Texas is another state which can not decide if it wants to allow this proven therapeutic herb to be part of its resident s lives. . . Despite the overwhelming evidence of a plathora therapeutic application. The way yhe Texas law is laid out is in regards to possessing cannabis Hemp in bud form. The legislators have been convinced that loose powdered or shake cannabis is less of a harm as it is of.less risk to be diverted to smokable products.
I know this seems counters intuitive as pre rolls and distillate are made of shake feed stock. However, so are more medicinally oriented products like slaves, lotioms, balms, tinctures, and edibles. As of the date of the article.i am referencing, Texans are allowed to order CBD products over the Internet but not from brick n mortar stores.

Kentucky, where a lot of Appalachias best illicit cannabis hails, there is rule against the low THC form of cannabis. I. Kentucky it is illegal to manage the crops, possess the flowers, stems, seeds, or otherwise of any part.ofnthe hemp plant or it's products without a licence. In Kentucky, while this is the case, you are still not allowed as a CBD user or to be CBD user to possess the raw flower. You are only allowed to possess the extracted products of the Hemp plant. However, none of these stipulations are in reference to the THC mimicing cannabis derivations.

I'm Indiana has a similar law set up. In Indiana your allowed to possess CBD products, even CBD Vaporized cartridges and I would.oresume then loose CBD extracts as well. The posesson of the raw flower, is again the issue that Indiana points to as being punishable by law. I find it hilariously amusing that so many states are so aapt to take.in one aspect of the new market but deny the smoking of the raw flower, despite the vaporized form of stronger and more powerful intensified CBD & CBD THC mimicing derivatives in vaporized cart form or.looe.comcentrate. While these products in no way compare to the psychoacti e and na cotic experience of cannabis Sativa, described by law as Marijuana it still has the ability especially for the light weight user to catch one a buzz.
Moreover, it has a swath of therapeutic applications. Many people who don't want to get high but get some rejuvanative or analgesic benefit from CBD products flock to these legal cannabis stores. And maybe they are the target audience for those MOOD commercials non Facebook. BUT one should know and understand why they are allowed to advertise the product in a way that to the uneducated in cannabis law and the common ear it sounds like their selling real weed.
They never say CBD. THE CLOSEST THEY come.is saying that, "...thanks to the 2018 Farm Bill..." This is the he infer nce to be paid attention to, as this is the legislation which made it ok for farmers to grow low THC Hugh CBD hemp on a federal level. This gave the FDA unfettered access to their choice of hemp supply from farmers across the country. And while the money's there, many farmers faced serious backlash from thei communities. Especially.in areas like those listed here, as you'll note there is a pattern, that being that these are highly conservative states. States where the people aren't big on change and where they are much more conservative all.around. many towns faced backlash even if the state followed federal suit with Hemp alone. . . Let alone Marijuana.
The main issue taking place in the Sorth Dakota happening is that they too are butthurt about the outpouring of THC mimicing compounds services from the isolated miniscule.levels.of THC and other psychoactive producing compounds in cannabis Hemp. Or the CBD and other non psychoactive cannabinoids is processed into HHC, THCO, THCP, etc. while these compounds are not as psychoactive as THC in delta 9 form, regular cannabis Marijuana form they do produce a significant high that is noted as enjoyable by non cannabis users.
In 2024 there are 3 states that have absolutely no medical program relat d to cannabis as Marijuana or allow it in is lts less potent more accepted as therapeutic form as Hemp. Those states are Idaho, Nebraska, and Kansas. I don't think it comes to any surprise to anyone familiar with US culture relative to yh wheat belt and corn belt to which these states belong. These are extremely conservative areas not to mention not exactly always caught up to 2924. Many of these small farm communities are still stuck in 1995, in industry as well as in thought. The propaganda of cannabis prohibition is still very much something with which to be dealt.

I have also noted that a lot.of users who take a "tolerance break" then begin smoking again, often feel the psychoactive levels of modern cannabis sativa (indica or sativa or hybrid) is far too much even in weaker strains. These individuals often find themselves using CBD Derived products. I have myself used a THCP, THCO, HHC pen and thoroughly enjoyed it. I call it a sort.ofmon the way to the party buzz. Not a full on psychoactive experience, but definitely a head change. However I also have a significant tolerance and use Dabs and flower daily.
The market has been taken and inundated by mass.industrial corporations without a face, and the hope.of.mom and pop shops in Maryland are all but a pipe dream at this point. As stated, the first and only black owned cannabis is forced to sell under one of those white owned mega corporations that was allowed to take over a market.built.in the backs of oersecution of those who created today's medicine, operating under Culta. On the over 75% white owned cannabis industry. Where 20% is black investment and that is All in 1 company, GLeaf cannabis.
Happy Eddies definitely deserves props for making it happen against all odds because despite the wording that legislation was designed to aid the disproportionately effected, they made zero attempts to make.that promise.come to fruition. The only thing they did was quiet everyone while they took over, white people can't speak or were racist, and black people and minorities believe they're being helped by this legislation. Nobody should need millions to grow cannabis, nobody should need years to actually get started.

I can grow tomatoes and corn and sell that. I can grow Azaleas and rhododendron, I can grow psychedelic producing cacti, I can grow psilocybin mushrooms in some areas, use ketamine in others, yet I am restricted from growing cannabis and selling it to my.friends who also enjoy my cannabis. For perspective, grow west operates just as.much as Appothecarium of Maryland, and they have a total of 8 registers and 8 preorder kiosks as well as online ordering.
Entrepreneurs were told they wouldn't need a physical location out of which to sell. I never suspected that would be because the entrepreneurs are being forced to operate under the industry acting as competition. The industry that pushed for the legislation is one and the same for which entrepreneurs are now.working under.
Most of the cannabis derivatives being conducted from CBD isolate and THC isolate is legal, however there has been questions raised about the lab grown concoctions of cannabis. I would imagine these are like the lab altered miniscule levels of THC, Known as Hexahydrocannabinol or HHC in short.
South Dakota is really being yanked back and forth and largely because of the propaganda still taking foot hold in the minds of boomers and older gen X and other younger conservatives I'm sure. If these legislators could step back from the FAILED WAR IN DRUGS, and realize that the DEAs raiding of California mom n pop shops.was the last battle of the Federal government against state legalized cannabis and get on board at least with the federal governments decisions about Hemp along this back n forth would be solved.
The main issue is really see in many of these situations where states are acting like marijuana is still the devil's lettuce and Hemo is somehow a lesser version thereof, but not if it produces a mind altering effect. Yet it's perfectly.ok for states like the 10% alcoholism Rate in Louisiana or the 5% using illicit drugs that leads to over 90% of the violent crime that takes place in those areas. Oddly enough too is that states where cannabis isn't so much accepted is the same states where the last drug which faced prohibition is over used and widely accepted.
Kentucky, South Carolina, Wyoming, and Idaho are the remaining states where cannabis is absolutely illegal as of February 1 2024. Then we have states where the legality of cannabis is more of a grey area than the difference between federal and state legislation in legalized states. These states are allowed to sell and residents can purchase and use CBD oil only which is Derived from Hemp, no THC PRODUCTS. In Texas you can have loose flower but not raw buds, and never for smoking or vaporization, but for use as feed stock in processing balms, lotions, etc. Iowa's law also states only CBD oils can be sold, and this is specifically CBD oils containing around o.5% THC. THIS puts it outside the range of the Hemp classification, but these are legal in the states I'm listing here where CBD oill and products are legal. CBD oil lcan obviously be made with and without THC, these states which I am listing as allowED CBD are allowing it with this level of THC PRESENT.
Wisconsin, Kentucky, Indiana, Tennessee, & Georgia are the states that are in a sort of.limbi grey area regarding low thc Cbd containig products. Many of these states have opted to try to divert the possibility of smoking cannabis by only.allowong particulates / ground up flower. This in my opinion honestly.is a continuation of the propaganda against cannabis. That smoking and ingesting the therapeutic flower is somehow dangerous.
Despite everything we know and have seen in legalized states like my own here in Maryland, these states can't break the propaganda of the war on drugs. But at least they're moving along further than states like South Carolina, Kansas, Idaho, and Wyoming where cannabis is absolutely illegal still. To think, all of this was brought about simply so the FDA could and can continue to produce a pharmaceutical with only a single proof trial behind it if 500 patients. Granted this is the largest study ever done on cannabis, it is still one study. The Stanley Brothers developed the strain " Hippies Disappointment" in 2011.
While I realize the company was non profit, and it was meant to help people and push cannabis into the real medical field, it only worked as far as the FDA sort of allowing Hemp. THEY didn't allowmit fornth people, and this is partially why I always will say the FDA stole the idea for Epidiolex, because any amount of work at all would've led them to the same conclusions as the Stanley Brothers, but they refuse to actually perform real research. The 500 patient study for Epidiolex is the largest cannabis study ever.

They were seeking to create a THC low and CBD HIGH strain of cannabis as the daughter of parents whom sought the brothers out noted their daughter had less seizures with weaker cannabis. Ergo, they hypothesized that possibly it was not the Tetrahydrocannabinol that was impacting the quelled seizure activity. By crossing an industrial hybrid with an Indica selection, they increased CBD and lowered the THC to less than 0.5%. While this is still the standard in some legislative books, the Stanley Brothers soon thereafter promised to really show the world that it isn't just about THC and lowered the THC to 0.3% and promised to do so then on.
This created the standard by which this cannabis was to be grown. While many may see it as a gift to humanity, the real gift would have been the government progressing the research and allowing us to have our plants. The same way the Stanley Brothers easily grew their cannabis thanks to lax Colorado cannabis law, can we not see the benefit in open unrestricted marketplaces. Is that not what capitalism is? Is capitalism not the little guy using his where with all and smarts to get ahead, to raise up from the literal soil, raise from the dirt.
Yet our government in the United States seems adamant to not allow this functionality to happen. One only need see the 20 years of the researchers sent to the University of Mississippi to study cannabis for therapeutic discoveries and given suboar intentionally poorly grown cannabis to do so. If those studies hadn't been messed with intentionally, we wouldnhav a vast catalogue of scientific data on cannabis. But today this is where we stand.
